Terms and Conditions of Use

These Terms and Conditions (“Terms”) govern your use of the New Day Budgeting mobile application (the “App”) and the services provided through it.
1. Acceptance of Terms
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.
2. License to Use the App
New Day Budgeting grants you a non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial purposes on a single device owned or controlled by you, in accordance with the usage rules set forth by Apple’s App Store Terms of Service and Google Play’s Terms of Service. All rights not expressly granted to you are reserved by New Day Budgeting.
3. Financial Services Disclaimer
A. Non-Fiduciary Relationship
New Day Budgeting is a personal budgeting and financial tracking tool. We are not a financial advisor, broker, lender, or credit card issuer. The App is intended to assist you in organizing your finances; it does not provide legal, tax, or investment advice. You are solely responsible for any financial decisions you make.
B. Data Inputs and System Accuracy
The App may use proprietary algorithms, machine learning, or other processes to categorize your transactions and offer budget insights. While we strive for accuracy, the output is based on inputs that may be incomplete or misinterpreted.
- New Day Budgeting is not responsible for any financial losses or damages resulting from your reliance on the App’s suggested categories, projections, or recommendations.
- All budgeting calculations and insights are illustrative and for informational purposes only.
C. Plaid Integration (Premium Users Only)
- Optional Service: The financial account linking feature via Plaid is optional and available only to Premium (Paid) Users.
- Third-Party Terms: When you use the Plaid integration, you are subject to Plaid’s terms and conditions and privacy policy. By using Plaid, you authorize Plaid to act as your agent to access and transmit your financial information from your financial institution.
- Data Accuracy: New Day Budgeting relies on data provided by Plaid and your financial institutions. We cannot guarantee the accuracy, completeness, or timeliness of this data. We are not responsible for any delay, failure, or inaccuracy of any financial information transmitted through Plaid.
4. Accounts and User Obligations
A. Account Responsibility
You must be 18 years or older (or the age of majority in your jurisdiction) to use the App. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
B. User Content (Financial Data and Inputs)
You retain ownership of any data, notes, custom categories, or financial inputs (collectively, “User Content”) you manually enter or create within the App. By using the App, you grant New Day Budgeting a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and analyze your anonymized and aggregated User Content for the sole purpose of improving the App, training internal algorithms, and developing new features. We will not use personally identifiable User Content for these purposes.
C. Prohibited Conduct
You agree not to use the App to:
- Violate any applicable law or regulation.
- Infringe upon the intellectual property rights of New Day Budgeting or third parties.
- Reverse engineer, decompile, or disassemble the App.
- Use any robot, spider, scraper, or other automated means to access the App.
5. Subscriptions and Billing
A. Subscription Fees
Access to Premium features, including the Plaid integration, is provided via paid subscriptions (“Subscription”). Subscription fees are billed in advance on a recurring basis (e.g., monthly or annually).
B. Payment and Automatic Renewal
Payment is processed by the respective platform (Apple App Store or Google Play Store) and is governed by their billing terms. Your subscription will automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
C. Cancellation and Refunds
You must manage your Subscription and cancel auto-renewal through your Apple or Google account settings. New Day Budgeting is generally not able to issue refunds directly for purchases made through the App Stores; refunds are subject to the policies of Apple and Google.
6. Intellectual Property
The App, including all software, text, images, graphics, and other content, is the property of New Day Budgeting and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App or its content.
7. Termination
New Day Budgeting may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.
A. Account Deletion
You may delete your account at any time via the App settings. Deletion of the App from your device does not automatically cancel your subscription; you must cancel that through your App Store account.
8. Disclaimer of Warranties
The App is provided to you on an “AS IS” and “AS AVAILABLE” basis, without warranty of any kind. New Day Budgeting disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to any warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be accurate, error-free, or continuously available.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall New Day Budgeting, its affiliates, agents, directors, or employees be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, data, or other intangible losses, that result from the use of, or inability to use, this App.
10. Required Apple Minimum Terms (App Store Users)
The following minimum terms are incorporated into this Agreement for users accessing the App through the Apple App Store:
- Acknowledgement: These Terms are concluded between you and New Day Budgeting only, and not with Apple. New Day Budgeting, not Apple, is solely responsible for the App and its content.
- Maintenance and Support: New Day Budgeting is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services.
- Warranty: New Day Budgeting is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable); to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever.1
- Product Claims: New Day Budgeting, not Apple, is responsible for addressing any claims related to the App or your use/possession of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual Property: You acknowledge that, in the event of any third-party claim that the App infringes that third party’s intellectual property rights, New Day Budgeting, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Third-Party Beneficiary: You and New Day Budgeting acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce the EULA against you as a third-party beneficiary thereof.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
12. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Tennessee, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Knox County, Tennessee.
